1. Acceptance of Terms

By accessing and using PetWalker.ai (the "Site" or "Platform"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site.

2. Description of Service

PetWalker.ai is a marketplace platform that connects pet owners with professional dog walkers. We provide:

• Walker discovery and booking services
• GPS tracking during walks
• Payment processing
• Photo updates and walk reports
• Review and rating systems
• Communication tools between owners and walkers

3. User Accounts

3.1 Account Creation

To use our services, you must:

• Be at least 18 years old
• Provide accurate, current information
• Maintain the security of your account credentials
• Notify us immediately of unauthorized access
• Accept full responsibility for all activity under your account

3.2 Pet Owner Accounts

As a pet owner, you represent and warrant that:

• You are the legal owner or authorized caretaker of the pet(s)
• You have authority to grant access to your home and property
• All pet information provided is accurate and complete
• You will disclose any aggressive behavior, medical conditions, or special needs
• Your pet is current on required vaccinations

3.3 Walker Accounts

To register as a walker, you must:

• Pass a background check
• Provide valid identification
• Maintain appropriate insurance (if required in your jurisdiction)
• Comply with all local laws and regulations
• Provide safe, professional services

4. Booking and Payments

4.1 Booking Process

• Pet owners initiate bookings through the Platform
• Walkers accept or decline booking requests
• Confirmed bookings create a binding service agreement between owner and walker
• Either party may cancel according to the cancellation policy

4.2 Pricing and Fees

• Walkers set their own rates
• PetWalker.ai charges a platform fee (deducted from walker payments)
• All prices displayed include applicable taxes where required
• Prices are subject to change; confirmed bookings honor the agreed rate

4.3 Payment Terms

• Payment is processed through Stripe
• Pet owners authorize payment upon booking confirmation
• Payment is released to walkers after walk completion
• Refunds follow our cancellation and dispute policies

4.4 Cancellation Policy

• 24+ hours before walk: Full refund
• 4-24 hours before walk: 50% refund
• Less than 4 hours: No refund
• Walker cancellation: Full refund plus credit (if applicable)
• Emergency exceptions may be granted at our discretion

5. Walker Responsibilities

Walkers agree to:

• Arrive on time for scheduled walks
• Follow owner instructions and pet care requirements
• Use GPS tracking during all walks
• Maintain control of pets at all times
• Clean up after pets
• Report any incidents, injuries, or concerns immediately
• Respect owner property and privacy
• Provide photo updates as agreed
• Maintain appropriate insurance

6. Pet Owner Responsibilities

Pet owners agree to:

• Provide accurate pet information
• Disclose all relevant behavioral or medical issues
• Ensure pets are leash-trained and controllable
• Provide necessary equipment (leash, collar, waste bags)
• Provide clear access instructions
• Ensure home entry is safe and accessible
• Be available for emergency contact
• Pay for services as agreed

7. GPS Tracking and Photos

• GPS tracking is mandatory for all walks
• Location data is shared with pet owners in real-time
• Walk routes are recorded for safety and verification
• Walkers may upload photos during walks
• Photos may be used for platform marketing (unless you opt out)

8. Reviews and Ratings

• Both owners and walkers may leave reviews
• Reviews must be honest, accurate, and non-defamatory
• We reserve the right to remove inappropriate reviews
• Reviews cannot be edited after 48 hours
• Fake or solicited reviews are prohibited

9. Safety and Liability

9.1 Background Checks

We conduct background checks on walkers but do not guarantee their accuracy or completeness. Background checks do not eliminate all risks.

9.2 Insurance

Walks may be insured through our platform insurance policy (where available). This does not replace your own pet insurance or homeowner's insurance.

9.3 Assumption of Risk

You acknowledge that pet care services involve inherent risks including:

• Pet injury or illness
• Property damage
• Loss or escape of pets
• Interaction with other animals or people

10. Prohibited Conduct

You may NOT:

• Use the Platform for illegal purposes
• Misrepresent yourself, your pet, or your services
• Circumvent platform payments to avoid fees
• Harass, threaten, or abuse other users
• Share login credentials
• Use automated tools to scrape data
• Interfere with Platform functionality
• Post false reviews or ratings
• Solicit users for competing services

11. Intellectual Property

All content on PetWalker.ai, including text, graphics, logos, photos, and software, is owned by us or our licensors and protected by copyright and trademark laws.

You may not:

• Copy, modify, or distribute Platform content without permission
• Use our name, logo, or branding without authorization
• Remove copyright or trademark notices

12. Disclaimers and Limitations of Liability

12.1 "AS IS" Service

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Availability or reliability of walkers
• Quality of services provided
• Accuracy of GPS tracking
• Uninterrupted or error-free operation
• Security of data transmission

12.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PETWALKER.AI SHALL NOT BE LIABLE FOR:

• Pet injury, illness, loss, or death
• Property damage
• Walker misconduct or negligence
• Payment disputes between users
• Loss of data or service interruptions
• Indirect, incidental, or consequential damages

OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless PetWalker.ai, its affiliates, and partners from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your pet's actions or behavior
• Services you provide or receive through the Platform
• Your violation of any rights of another party

14. Dispute Resolution

• Disputes between users should be resolved directly when possible
• We may facilitate communication but are not required to mediate
• Unresolved disputes may be submitted to binding arbitration
• You waive the right to participate in class action lawsuits

15. Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect and use your information.

16. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted with an updated "Last Updated" date. Continued use after changes constitutes acceptance of the new Terms.

17. Termination

We may suspend or terminate your access to the Platform at any time, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Safety concerns
• Repeated negative reviews or complaints
• Any reason at our sole discretion

You may delete your account at any time through account settings.

18. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.

19. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
